We comply with the relevant legal provisions on the protection of personal data:

  • The Act of August 29, 1997 on the Protection of Personal Data (consolidated text: Journal of Laws of 2002, No. 101, item 926, as amended);
  • The Act of July 18, 2002 on the Provision of Electronic Services (Journal of Laws No. 144, item 1204, as amended);
  • The Regulation of April 29, 2004 of the Minister of Internal Affairs and Administration on the documentation of personal data processing and technical and organizational conditions that should be met by devices and IT systems used for processing personal data (Journal of Laws No. 100, item 1024).

We also protect your data from the technical side, using the best quality equipment and safeguards. The provisions below are intended to inform you about the data we collect when you use our website, how it is used, corrected, and deleted, and also define the rules for storing and accessing information on your device (computer, laptop, smartphone, etc.) using Cookies, serving the performance of electronic services requested by the User, by Elmal Sp. z o.o. with its registered office at ul. Górecka 32, 43-430 Skoczów, which constitutes the fulfillment of information obligations resulting from Art. 173, Art. 174, and Art. 209 of the Telecommunications Law Act (Journal of Laws of 21.12.2012, item 1445).
This Privacy and Cookies Policy characterizes and defines the data that are collected from the User of the elmal.pl website, hereinafter referred to as the Website, belonging to Elmal Spółka z ograniczoną odpowiedzialnością.

  • Who is the Data Controller?

    The data controller is Elmal Sp. z o.o. with its registered office at ul. Górecka 32, 43-430 Skoczów, hereinafter referred to as the Controller or the Company.

  • Scope of collected data and their use.

    During the User's visit to the Website, our servers automatically record the so-called system logs – anonymous information such as: the time of the User's visit, IP address, URL address, information about the user's browser, URL of the previously visited page (the so-called referrer link, if the user navigated to the page via a link), etc. The collected logs are stored for an indefinite period as auxiliary material used to administer the website. The information contained in them is not disclosed to anyone except persons authorized to administer the server and the website.

    The Website also collects anonymous data regarding visited pages, such as: number of visits, country, browser, time of visit, etc. We analyze the collected data using a solution from an external provider, which is Google Analytics. The tool operates based on the so-called cookie files and does not provide data enabling the identification of a person.

    The Website may use the "Share" function, which enables sending information about our pages to social networking sites (e.g. Facebook, Twitter, etc.) or to an e-mail address. It operates on the basis of the "Add This" service.

    The Website may use Google Analytics features that have been implemented based on display advertising (e.g. remarketing, Google Display Network impression reporting, DoubleClick Campaign Manager integration, or Google Analytics Demographics and Interest Reporting). The Website and third-party vendors, including Google, use first-party cookies (such as Google Analytics cookies) and third-party cookies (such as DoubleClick cookies) together to inform, optimize, and serve ads based on someone's past visits to the Website.

    When contacting us using the contact form, in the event of subscribing to our newsletter or other system messages, the User may provide the following data: telephone number, e-mail address, postal address, first and last name, etc., as well as other personal data, i.e. date of birth, age, gender, etc. These data may be used by the Controller for statistical purposes, behavioral studies, and also – if the User has agreed – for commercial purposes of the Company.

    Additionally, occasionally, by means of surveys sent via electronic mail or made available directly on the website, the Website may collect demographic and profile data from Users (such as education, age, income). This data is used to study the preferences of Users and adapt the Company's offer to their expectations. Disclosure of this data is always voluntary, and the User may at any time resign from receiving surveys in the manner specified each time in the survey sent to the User (e.g. in the footer of the message).

    Any advertising content related to the commercial activities of the Company and its contractors may be sent to Users only with their consent, in accordance with the provisions of Art. 10 of the Act of July 18, 2002 on the Provision of Electronic Services (Journal of Laws 2002, No. 144, item 1204, as amended). Consent in this respect is revocable.

    The User providing their data specified in points 5 and 6 on the Website agrees to its transfer, storage, and processing (in accordance with the applicable provisions of the Personal Data Protection Act of 29.08.1997) by the Website. By providing their data, the User declares at the same time that they have read the "Privacy and Cookies Policy" in force on this Website.

  • User rights.

    The User providing their data specified in paragraphs 5 and 6 on the Website agrees to its transfer, storage, and processing (in accordance with the applicable provisions of the Personal Data Protection Act of 29.08.1997) by the Website. By providing their data, the User declares at the same time that they have read the "Privacy and Cookies Policy" in force on this Website.

    Personal data is not shared with other entities for marketing purposes unless the User consents to this. Providing any personal data is voluntary. The Company may share collected information that does not identify a specific person publicly and with partners, such as publishers, advertisers, or operators of connected sites.

    In the event of a merger, acquisition, or sale of the Company's assets, we will ensure the confidentiality of all personal data and notify the relevant users before their personal data is transferred or becomes subject to a different privacy policy.

    The User has the opportunity to decide to what extent their personal data will be used.

    The User has the right to supplement, update, correct personal data, temporarily or permanently suspend its processing, or delete it if it is incomplete, outdated, untrue, or was collected in violation of the law or is no longer needed to achieve the purpose for which it was collected, as well as the right to object, in the cases specified in Art. 23(1)(5) of the Personal Data Protection Act, when the Controller intends to process User data for marketing purposes or transfer it to another data controller.

    Any changes regarding their personal data can be made by the User by sending an appropriate declaration of intent to the address of the Controller.

    The Controller reserves the right to refuse to delete User data if its retention is necessary to satisfy claims or if required by applicable law.

    In the event of an inspection by the Inspectorate General for Personal Data Protection, the User's data may be made available to the Inspectorate's employees in accordance with the Personal Data Protection Act.

  • Use of Cookies

    The Website uses the so-called "cookies". They identify the browser and improve the operation of the website. Cookies do not contain any personal data. The Website may also use an Anonymous Identifier, i.e. a random string of characters used for the same purpose as a cookie on platforms including some mobile devices where cookie technology is not supported.

    In the browser settings, you can choose the option to reject cookies, however, some functions of the website may not work properly. The absence of changes to these settings means acceptance of the cookies used here.

    Third-party websites, materials or links to which may be found on the Website (e.g. Vimeo, YouTube), may also use cookies that enable logging in and serve to deliver advertisements corresponding to the user's preferences and behavior. In such a case, the Website recommends reading the Privacy Policy of the target websites. This Privacy Policy does not regulate the rules for using cookies by third parties.

    The Controller reserves the right to use the services of third parties to compile statistics on the use of the Website. We ensure that in such a case no data identifying Users will be transferred to such entities.

    In advertisements placed on the pages of the Website, third-party cookies may be used to enable the analysis of the effectiveness of the advertising campaign.

  • What are Cookies?

    "Cookies" are small text files stored in users' devices, i.e. smartphone, laptop, computer, and all other devices used to browse the internet. A "cookie" stores information about the website visited by the User, the "lifetime" (i.e. the existence time of the cookie), and a unique browser number.

    "Cookies" are used to adapt the content of websites (e.g. advertising content) to the user's preferences and to speed up the operation and use of websites. "Cookies" are also used to collect statistical and behavioral data of website users. This data is not used to identify the identity of users.

    Cookies can be used only to perform specific functions for the user. Such data is encrypted in a way that prevents access to it by unauthorized persons.

    The Website uses two types of files: temporary (they exist until logging out of the website or turning off the software/web browser) and "persistent" files (they remain for the time specified in the parameters of "cookie" files or until manual deletion by the User). Third parties also have their "cookies", e.g. Facebook; information on the privacy policy of partners' cookies can be found on their websites.

In the new window that opens, select "Block sites from setting any data". We also press "All cookies and site data" and in the opened window click "Remove all".

    Microsoft Internet Explorer browser: To block Cookies, select the options in turn: "Tools", then "Internet Options", then the "Privacy" tab, and then "Advanced". In the new window, select "Override automatic cookie handling", then select "block" twice and confirm with "OK". To delete previously saved Cookies: select the options in turn: "Tools", then "Internet Options" and under the "Browsing history" option click "Delete...". Then select the options: "Preserve Favorites website data" and "Cookies" and click "Delete".

    Mozilla Firefox: To block cookies, select "Tools", then "Options" and the "Privacy" tab. There, select "Firefox will use custom settings for history" and uncheck "Accept cookies". Confirm with "OK". To delete saved cookies: Select "Tools" and "Clear Recent History". Select the time range to clear: "Everything" and check "Cookies". Confirm by pressing "OK".

    In the Opera browser – to block cookies – in the menu select the option "Settings", then "Preferences...", then "Advanced" and "Cookies". From the available options, select "Never accept cookies" and click "OK". To delete already collected cookies – in the menu select the option "Settings", then "Preferences...", then "Advanced" and "Cookies". Then click "Manage cookies" and in the newly opened window click the "Delete" button for each item.

    In the Safari browser, select "Preferences" and click the "Security" icon. Here you select the security level in the "Accept cookies" area.

    In mobile device browsers: The cookie handling function may differ on different models of phone or mobile device. Therefore, we encourage you to familiarize yourself with the privacy options in the documentation on the website of your mobile device manufacturer.

  • What are Anonymous Identifiers and what function do they perform?

    To display ads in services where cookies may not work (e.g. in mobile applications), the Website may use anonymous identifiers. An anonymous identifier is a random string of characters used for the same purpose as a cookie on platforms including some mobile devices where cookie technology is not supported.
